Acceptance of These Terms

These Terms of Service govern your use of this website, operated by Metropolitan Heating and Air Conditioning Ltd. ("we", "us" or "our"), whose business address is 20 Venture Dr #17, Scarborough, ON M1B 3R7. By browsing this site, submitting a form, or requesting service through it, you agree to these terms. If you do not agree, please do not use the site.

These terms apply to the website itself. Work we perform at your property is governed additionally by the written estimate, work order or service agreement you sign, which prevails over this page if the two ever conflict.

Who May Use This Site

You must be at least the age of majority in your province or state, and able to enter a binding contract, to request service or submit an application through this site. You agree to give accurate, current and complete information, to keep it accurate, and not to impersonate anyone or submit a request on someone else's behalf without their permission.

You agree not to use this site to break the law, to interfere with its operation or security, to scrape or harvest it by automated means without our written permission, to introduce malicious code, or to attempt to gain unauthorised access to any part of it or to any account, system or network connected to it.

Information, Estimates and Pricing

The content on this site — including service descriptions, learning-centre articles, efficiency comparisons, rebate explanations and equipment guidance — is general information about heating, cooling and indoor-air-quality systems in Ontario. It is not an engineering assessment of your home, and it is not advice you should act on without having your specific system looked at.

Nothing on this site is a binding offer or a quoted price. All work is subject to a written estimate and to our agreement to perform it. Pricing, equipment availability, lead times, scope and scheduling are confirmed at the time of service and may change if site conditions, code requirements or supply differ from what was assumed.

Rebate, incentive and grant amounts referenced anywhere on this site are set and administered by third parties — utilities, manufacturers, and provincial or federal programs — and can change or end without notice. Eligibility is determined by the program, not by us. Always confirm current terms with the program before relying on an amount.

Licensing, Permits and Safety

Metropolitan Heating and Air Conditioning Ltd. is a licensed and insured Ontario HVAC contractor. Gas work in Ontario is performed under the Technical Standards and Safety Authority (TSSA) framework, and electrical work under the Electrical Safety Authority (ESA) framework, by qualified personnel.

Where a permit or inspection is required for the work you request, we will tell you before the work proceeds. All work is performed in accordance with applicable codes, manufacturer instructions and regulations in force at the time.

Scheduling, Access and Cancellation

Appointment windows are estimates. Emergency calls, weather and traffic across the GTA can move a window, and we will contact you if that happens.

You are responsible for giving our technicians safe, lawful access to the equipment and for disclosing known hazards at the property. If we cannot safely access or work on the equipment, or if nobody is present to authorise the work, a trip charge may apply. Cancellation, deposit and restocking terms, where any apply, are stated on your written estimate.

Warranties and Disclaimers

Workmanship and equipment warranties, where offered, are set out in the documents we give you at the time of service and in the manufacturer's own warranty. Nothing on this website extends, replaces or adds to those warranties.

The website itself is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title or non-infringement. We do not warrant that the site will be uninterrupted, timely, secure or error-free, or that any content on it is complete, current or accurate. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this paragraph may not apply to you.

Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or use, arising out of or in connection with your use of this website or your reliance on its content — whether the claim is framed in contract, tort, negligence, strict liability or otherwise, and even if we were advised that such damages were possible.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to this website is limited to one hundred Canadian dollars (CAD $100). This limitation does not apply to liability that cannot be limited or excluded under applicable law, and it does not limit our obligations under a signed service agreement for work performed at your property.

Indemnification

You agree to indemnify and hold harmless Metropolitan Heating and Air Conditioning Ltd., its owners, officers, employees and contractors from any claim, demand, loss or expense (including reasonable legal fees) arising from your misuse of this website, your breach of these terms, or your violation of any law or of the rights of a third party.

Intellectual Property

All content on this site — text, articles, photographs, illustrations, diagrams, layout, design, logos, trade names and software — is owned by Metropolitan Heating and Air Conditioning Ltd. or its licensors and is protected by Canadian and international copyright and trademark law.

You may view, download and print pages for your own non-commercial use in evaluating or arranging our services. You may not copy, republish, redistribute, sell, licence, frame, mirror or create derivative works from any part of this site, or use our name, logo or trade dress, without our prior written permission. Manufacturer names and logos referenced on this site belong to their respective owners and are used only to identify the equipment we service and install.

Content You Submit

If you send us a review, photograph, testimonial, job application or other material, you confirm that you have the right to send it and you give us a non-exclusive, royalty-free licence to use it in connection with our business, including on this site and in our marketing, unless you tell us otherwise in writing. Do not send us anything confidential that you do not want used this way, and never send payment card details through a web form or email.

Automated Tools and AI Disclosure

This website does not currently operate an AI chatbot or automated chat assistant. If we add one, it will identify itself as an AI assistant before you type anything into it, and it will offer a clear route to a human on our team. Automated spam protection (Google reCAPTCHA v3) runs on our forms to keep them usable; it scores submissions and does not make decisions about your service request.

Privacy and Your Choices

Third-Party Links and Services

This site links to manufacturers, financing partners, review platforms, rebate programs and social networks that we do not control. We provide those links for convenience only. We are not responsible for their content, their availability, their terms or their treatment of your information, and a link is not an endorsement.

Governing Law and Jurisdiction

These terms, and any dispute arising out of or relating to them or to this website, are governed by the laws of the Province of Ontario and the laws of Canada applicable in Ontario, without regard to conflict-of-laws rules.

You agree that the courts of the Province of Ontario have exclusive jurisdiction over any such dispute, and you attorn to the venue of Toronto, Ontario, subject to any non-waivable right you have to bring a claim in your own place of residence or before a consumer-protection body.

Changes, Severability and Contact

We may revise these terms from time to time; the revised version takes effect when posted on this page, and the date below shows when it was last changed. If any provision of these terms is held unenforceable, the rest remain in force and the unenforceable provision is applied to the greatest extent permitted. Our failure to enforce a provision is not a waiver of it.
